Abstract Negligence is considered as one of the civil torts in English law, as well as other Feeders civil torts as a nuisance, trespass to land, trespass to persons, defamation, vicarious liability, liability for animals, liability for defected products, and strict liability.All of these kinds of torts are included and mentioned strictly in English law of tort, which is regarded as an unwritten law based upon judicial precedents issued by English courts.The study aims at defining negligence, determining its main characteristics, drawing a distinction Floor Brush between it and some other kinds of English civil tort, as well as explaining the legal foundation upon which the legal liability of negligence is based and comparing it with that of the legal liability arising from negligence in Iraqi civil law.
